General terms and conditions of sale

Preamble

These general terms and conditions of sale (the "GTC") define the rights and obligations of the parties for the sale of bikes, conversion kits, accessories and workshop services (the "Products") by Nouveau Cycle Inc. (the "Seller") to its customers (the "Customer").

Article 1 - Purpose and scope

The GTC apply to all Product sales concluded between the Seller and the Customer, excluding any other terms unless the parties have given prior express written agreement.

Article 2 - Bike sales

2.1. Bike sales are final. The Customer is encouraged to complete thorough test rides before purchase to make sure the bike meets their expectations.

2.2. Once the bike leaves the workshop, the sale is considered final and cannot be cancelled.

Article 3 - Conversion kits

3.1. Conversion kits cannot be returned after purchase.

3.2. The Customer is responsible for ensuring the conversion kit is compatible with their bike before purchase.

Article 4 - Bike conversion

4.1. The bike conversion service is non-refundable.

4.2. If the Customer wants to remove the conversion kit from their bike, labour costs are the Customer's responsibility.

Article 5 - Merchandise returns

5.1. The Customer may return other merchandise, excluding bikes, conversion kits and batteries, within 14 days of purchase.

5.2. Returned items must be in perfect condition, in their original packaging and accompanied by proof of purchase.

5.3. Only products that can be resold as-is will be accepted.

Article 6 - Labour warranty

6.1. Labour for repairs and maintenance services is warranted on a case-by-case basis.

6.2. Warranty duration and conditions vary depending on the nature of the work performed and the parts used.

Article 7 - Financing and reservations

7.1. The Seller does not offer financing solutions for Product purchases.

7.2. A $150 deposit is required when booking any electric conversion appointment. The deposit is refundable if cancellation is made at least seven (7) days before the scheduled appointment date. After that deadline, the deposit is non-refundable, but can be transferred once to another appointment.

Article 8 - Additional information

8.1. Accepted payment methods are credit card, debit card and cash.

8.2. Applicable sales tax will be added to the total purchase price.

Article 9 - Intellectual property

The Seller's website content, including logos, trademarks, images and text, is protected by intellectual property rights. Any unauthorized reproduction or use is prohibited.

Article 10 - Governing law and jurisdiction

These GTC are governed by the laws applicable in Quebec. In the event of a dispute, the courts of Quebec shall have exclusive jurisdiction.


Personal information protection policy

Preamble

Nouveau Cycle (the "company") is committed to protecting the confidentiality, security and integrity of the personal information we collect from our customers. This policy complies with Quebec's Law 25 and follows the principles established by the Commission d'accès à l'information du Québec. It describes the information we collect, why we collect it, how it is used, the safeguards in place and the rights of the individuals concerned.

1. Types of personal information collected

As part of its activities, Nouveau Cycle collects the following types of personal information:

  • Full name
  • Phone number
  • Email address

This information is collected only when necessary for the purposes described below.

2. Purposes for collecting personal information

Personal information is collected and used for the following purposes:

  • File follow-up and service request processing: We use personal information to properly manage customer files and provide personalized follow-up service.
  • Billing: The information is used to generate and send invoices to customers for the services provided.

3. Consent and alternatives to collection

Customers may choose not to provide personal information in certain circumstances, particularly when creating customer accounts. Upon request, it is possible to make a purchase without creating a customer account. Customers may also choose to receive information about their file in person rather than electronically.

4. Access to personal information within the company

Access to collected personal information is limited according to staff roles and responsibilities:

  • Management staff: Management staff have access to all customer personal information to ensure proper file management, follow-up and processing.
  • Customer service staff: Customer service staff have access only to the identification and contact information strictly necessary to provide quality service and respond to requests.

5. Security of personal information

Nouveau Cycle implements appropriate security measures to protect personal information against unauthorized access, disclosure, alteration or destruction. These measures include:

  • Secure online system: Personal information is stored in an online system protected by strong security measures such as secure authentication and encryption.
  • Premises security: Our premises are locked and secured to prevent unauthorized physical access to data.

6. Access and correction of personal information

In accordance with Law 25, any person covered by this policy has the right to access their personal information, request corrections or ask questions about how their information is used. To exercise this right, requests must be made in writing to: [email protected].

7. Retention period for personal information

Personal information will be kept only for as long as necessary for the purposes for which it was collected, unless a law requires or authorizes a longer retention period. Once those purposes have been fulfilled, or after the legal retention period, personal information will be securely deleted.

8. Sharing and disclosure of personal information

Nouveau Cycle does not disclose or share customers' personal information with third parties unless required by law or unless explicit consent has been obtained from the customer. We undertake not to sell, rent or commercialize collected personal information.

9. Changes to the personal information protection policy

Nouveau Cycle reserves the right to modify this personal information protection policy at any time to reflect changes in laws, internal practices or any other relevant reason. Any significant change will be communicated to customers appropriately, for example by email or through our website.

10. Person responsible for personal information protection
